Good to know: Right of first refusal for the tenant: When does it apply?

A tenant's right of first refusal gives them the opportunity to buy the flat they live in before it is sold to a third party.

A tenant's right of first refusal comes into effect in special cases when the rented flat is to be converted into a condominium and then sold. Here are the most important points:

Conversion to condominium ownership: the tenant's right of first refusal only applies if the flat is converted into a condominium and the landlord wishes to sell it.
Duty to inform: The owner must inform the tenant in writing of the intended sale and offer him the right of first refusal.
Conditions: The tenant has the right to buy the flat on the same terms that a third party would pay. He has two months to exercise his right of first refusal.
Exceptions: There is no right of first refusal if the flat is to be sold to a member of the landlord's family.

It is important that tenants and landlords are informed about their rights and obligations in order to avoid misunderstandings and legal conflicts. Both parties should seek legal advice if they are unsure.
